Enforceability of 18 U.S.C. § 1302

Application of 18 U.S.C. § 1302 to prohibit the mailing of truthful advertising concerning certain lawful gambling operations would violate the First Amendment. Accordingly, the Department of Justice will refrain from enforcing the statute with respect to such mailings. The OLC does not provide release dates for its opinions, so the release date listed is the date on which the opinion was authored.
