Legality of Fixed-Price Intergovernmental Agreements for Detention Services
The Department of Justice has authority to enter Intergovernmental Agreements with state or local governments to provide for the detention of federal prisoners and detainees on a fixed-price basis and is not limited to providing compensation for costs under such agreements. The OLC does not provide release dates for its opinions, so the release date listed is the date on which the opinion was authored.
